Terms & Conditions

These Terms and Conditions (“Terms”) govern your use of makedivision.com (the “Site”) and your purchase of the AI Marketing Team System (the “Product”) from Optimizuok MB (“we”, “us”). By placing an order you agree to these Terms.

1. Who we are

2. What you are buying

The Product is a digital marketing system consisting of the AI Marketing Team plugin for Claude (five specialist roles), the Business Profile workflow, the shared team protocol, the Playbook, the Quick Start guide, the workflow library and setup documentation.

The Product is a one-off purchase. It is not a subscription, and no recurring charge is made.

3. What you need in order to use it

The Product runs inside Claude, a service operated by Anthropic. You must have your own Claude account, obtained separately and at your own cost, and your use of Claude is governed by Anthropic’s own terms.

We are an independent business. We are not affiliated with, endorsed by or partnered with Anthropic, Meta Platforms or Google. The Product is built and tested for Claude; we make no claim that it works with other AI systems.

If Anthropic changes, restricts or discontinues Claude or its plugin functionality, this may affect how the Product works. We will make reasonable efforts to keep the Product usable, but we cannot control third-party services.

4. Eligibility

You must be at least 18 years old and legally able to enter into a contract. You may buy as a consumer or on behalf of a business; where you buy for purposes relating to your trade or profession, the consumer provisions in sections 7 and 8 do not apply to you.

5. Orders, prices and payment

Prices are shown on the Site at the time of ordering. A contract is formed when we confirm your order by email.

Payments are processed by Stripe. We do not receive or store your full card details. You must be authorised to use the payment method you provide.

Applicable VAT is calculated and shown at checkout. Business customers within the EU may supply a valid VAT number where the reverse-charge mechanism applies.

6. Delivery

The Product is delivered digitally. Access details are sent to the email address given at checkout, normally immediately after payment is confirmed. Please check your spam folder before contacting us about missing access.

7. Right of withdrawal and its waiver (consumers)

Under EU consumer law a consumer normally has 14 days to withdraw from a distance contract. For digital content supplied immediately, that right does not apply where you have given prior express consent to immediate supply and acknowledged that you thereby lose your right of withdrawal (Article 16(m) of Directive 2011/83/EU).

At checkout you are asked to confirm both of these. If you give that confirmation and we grant access, your statutory right of withdrawal ends. We confirm this to you in your order confirmation email.

If you do not give that confirmation, your 14-day statutory right of withdrawal applies as normal and you may cancel by emailing us within 14 days of purchase.

Separately from the above, we offer the voluntary guarantee in section 8.

8. Our 14-day money-back guarantee

In addition to your statutory rights, we voluntarily offer a 14-day money-back guarantee. If the Product is not right for you, email hello@makedivision.com within 14 days of purchase and we will refund your payment in full, to the original payment method, normally within 14 days of approving the request.

This voluntary guarantee does not apply where:

  • the Product, or any part of it, has been copied, shared, resold, redistributed or published in breach of section 9;
  • you have previously received a refund for the same Product;
  • the request is made in bad faith or is part of a pattern of repeated purchase-and-refund behaviour.

Nothing in this section limits the statutory rights of consumers, including rights in respect of digital content that is not as described or not of the quality you are entitled to expect.

9. Your licence

On payment we grant you a non-exclusive, non-transferable, worldwide licence to use the Product, including for commercial purposes.

You may:

  • use the Product for your own business;
  • use it in work you carry out for your clients;
  • use, adapt and keep the outputs it produces in your own and your clients’ businesses.

You may not:

  • resell, sublicense, redistribute, publish or share the Product or any substantial part of it;
  • white-label or present the Product or its underlying prompts, workflows or documentation as your own product;
  • share your access with people outside your organisation, or make the files publicly available;
  • use the Product to build or train a competing product.

We may terminate your licence if you materially breach these restrictions.

10. Intellectual property

The Product, the Site and all their content remain the intellectual property of Optimizuok MB. Nothing in these Terms transfers ownership to you. Outputs you generate using the Product are yours to use, subject to section 9.

11. Updates

Product updates are included where they form part of the offer in effect at the time of your purchase. Any limitation on updates is stated at checkout. We may improve, change or discontinue parts of the Product, provided this does not substantially reduce what you paid for.

12. No guarantee of results

The Product provides analysis, structure, recommendations and documentation. It does not run, manage or make changes to your advertising accounts. Every recommendation requires your own review, judgement and approval.

We make no guarantee about results, performance, revenue or earnings you may obtain. Outcomes depend on your market, offer, budget, execution and many factors outside our control.

13. Acceptable use

You agree not to use the Product or the Site unlawfully, to infringe anyone’s rights, to attempt to gain unauthorised access to our systems, or to disrupt the Site. You are responsible for the lawfulness of the data you provide to the Product, including any personal data belonging to your clients.

14. Liability

We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud.

Subject to the above, our total liability arising from these Terms or the Product is limited to the amount you paid for it. We are not liable for indirect or consequential loss, or for loss of profit, revenue, goodwill, business or data.

If you are a consumer, your mandatory statutory rights are not affected by this section.

15. Changes to these Terms

We may update these Terms from time to time. The version in force at the time of your purchase applies to that purchase. The current version is always published on this page.

16. Governing law and disputes

These Terms are governed by the law of the Republic of Lithuania. If you are a consumer resident in another EU country, you keep the protection of any mandatory provisions of the law of your country of residence.

If you have a complaint, please contact us first at hello@makedivision.com — most issues are resolved quickly this way.

Consumers in Lithuania may refer an unresolved dispute to the State Consumer Rights Protection Authority (Valstybinė vartotojų teisių apsaugos tarnyba), Vilniaus g. 25, Vilnius, vvtat.lt. Consumers resident elsewhere in the EU may use the alternative dispute resolution body competent in their country.
